

PREAMBLE
These general terms and conditions of sale ("GTCS") apply to any use of the website by a Customer ("the Customer") for the booking of any accommodation and services within Bellevigne Bourgogne, with the exception of the Spa des Tannins services which have their own general terms and conditions of sale accessible here, through the following channels:
- On the website https://www.bellevigne-hotels.com/("the Site");
- Call or e-mail Bellevigne Bourgogne;
- On site at Bellevigne ,
- Through Partners.
Bellevigne Bourgogne reserves the right to adapt or modify these terms and conditions of sale at any time. The general terms and conditions of sale applicable to a reservation are those published on the Site on the date the reservation is made.
The GCS may be supplemented by the conditions of sale of the fare reserved, which are expressly mentioned in the description of the fare selected at the time of booking on the Site. The customer must confirm by ticking the box that he/she has read and accepted these GTC and the conditions of sale for the fare booked before definitively confirming the booking; no booking is possible without this agreement.
For all other booking methods, the Customer receives the GTC, the Conditions of Sale for the fare booked and the Privacy Policy in response to his/her booking request. Confirmation of the reservation by the Customer implies full and unreserved acceptance of their provisions.
The following information is provided on the Site and within the reservation system:

- The essential characteristics of the complementary and optional services offered
- Prices include all taxes

All information provided on the Site is presented in both French and English.
All customers acknowledge that they have the capacity to contract, i.e. that they are of legal age and not under guardianship.
Definitions
The terms below have the following meanings:
"Booking Confirmation": electronic document sent to the Customer to confirm that the reservation has been taken into account, summarizing the characteristics of the accommodation and services booked by the Customer.
"Customer": an individual acting exclusively for his or her own personal needs.
"Reserved rate sales conditions": price applied on the date selected by the Customer for a category of room with or without service, together with its payment conditions and cancellation conditions.
" Bellevigne Bourgogne" refers to SH Chambolle (RCS Dijon 948024930).
"Partners": refers to any service provider or partner who has entered into a service provision contract or partnership agreement with the operator Bellevigne Bourgogne.
"Site": refers to the website https://www.bellevigne-hotels.com/.
Object
These terms and conditions define the rights and obligations of the customer and Bellevigne Bourgogne. They govern all stages necessary for the booking and follow-up of the reservation between the contracting parties.
The customer acknowledges having read and accepted these general terms and conditions of sale and the terms and conditions of sale of the reserved fare.
Reservation
The customer chooses hosting and services from among those offered by Bellevigne Burgundy according to his needs.
The Customer acknowledges that he/she has taken cognizance of the nature, price, destination and booking terms of the accommodation and services and has requested and obtained the necessary and/or additional information, in particular the Conditions of Sale for the rate booked, in order to make his/her booking with full knowledge of the facts.
For reservations of more than 5 rooms, the customer must contact Bellevigne Bourgogne by telephone or e-mail (contact@bellevigne.com) to obtain the preferential group rate and the conditions of sale for this rate, and to proceed with the reservation. Should the customer make more than 5 consecutive bookings on the site for the same length of stay, Bellevigne Bourgogne reserves the right to cancel these bookings and contact the customer directly.
The customer is solely responsible for his choice of hosting and services, and for ensuring that they meet his needs, and Bellevigne Bourgogne cannot be held liable in this respect.
The reservation is deemed accepted by the customer at the end of the reservation process.
All bookings are nominative and may under no circumstances be transferred to a third party, whether free of charge or in return for payment. Any reservation made for a third party must be made in the name of the third party.
Reservation process
Customer reservations are made directly :
- online on the Site ;
- by telephone or e-mail (contact@bellevigne.com) to Bellevigne Bourgogne;
- on site at Bellevigne ;
- through Partners.
The reservation request is confirmed upon receipt by the Customer of the Reservation Confirmation, sent by Bellevigne Bourgogne or by the Partner.
At the time of booking, the Customer must provide a certain number of mandatory details, including certain personal details required to process the booking. The customer must also indicate the number of people benefiting from the services, as well as their age, any minor over 13 being considered an adult.
The Customer attests to the truthfulness and accuracy of the information provided.
The reservation procedure includes the following steps:
- Step 1 - Choosing the dates and number of participants
- Step 2 - Choose your room and Terms of sale for the rate you have booked,
- Step 3 - Selection of one or more additional services, if required,
- Step 4 - Presentation of the booking summary, total price, terms and conditions of sale for the rate booked, including payment and cancellation conditions, any necessary changes to the choice of services (date, room, rate, additional service), and information on tourist tax,
- Step 5 - Mandatory provision of contact details by the customer, and optional provision of name/first name/age of room occupants and special requests,
- Step 6 -On the Site, the Customer confirms, by ticking the box, that he/she has read and accepted the General Terms and Conditions, the Conditions of Sale for the fare booked and the Privacy Policy before definitively confirming his/her booking; no booking is possible without this agreement.
- Step 7 -Communication of credit card numbers in the event of a guarantee or prepayment request,
- Step 8 - Confirmation and validation of reservation and payment by the customer. Entering the bank details constitutes the customer's acceptance of the booking and commits him/her contractually to Bellevigne Bourgogne.
- Step 9 - The customer receives a booking confirmation e-mail. This e-mail summarizes the booking date, the services booked, the prices with details of any applicable taxes, the Conditions of Sale for the fare booked (including cancellation conditions), accepted by the customer, and the link for consulting these General Terms and Conditions and the privacy policy. If the confirmation e-mail is not received within 24 hours of booking, it is the Customer's responsibility to contact Bellevigne Bourgogne to check that the information provided is correct and that the booking has been taken into account.
Cancellation or modification
In accordance with article L. 221-28 12° of the French Consumer Code, customers are reminded that they do not have the right of withdrawal provided for in article L. 221-18 of the French Consumer Code.
The Conditions of Sale for the rate booked and accepted by the Customer specify the terms and conditions for cancelling and/or modifying the booking. If the customer opts for a flexible rate, he/she must take all necessary steps to ensure that Bellevigne Bourgogne can debit his/her bank card for the amount of the reservation remaining to be paid from the end of the period open to the customer to cancel his/her reservation, and cannot oppose this. In the event that payment by the customer has not been received despite reminders from Bellevigne Bourgogne, Bellevigne Bourgogne may cancel the reservation and retain the deposit paid by the customer.
Reservations with prepayment for a non-refundable, non-cancellable rate cannot be modified or cancelled, and no refunds will be made in the event of interruption of the stay for reservations with prepayment for a non-refundable, non-cancellable rate.
When the terms and conditions of sale of the rate booked allow it, the cancellation or modification of a booking made from the site can be made directly on the link in the Booking Confirmation "Modify or cancel a booking" by entering the booking reference and the pin code indicated in the booking confirmation e-mail, or by contacting BellevigneBourgogne. For reservations made directly with Bellevigne Bourgogne at the reception desk or by telephone, cancellations or modifications must be made directly with Bellevigne Bourgogne.
The conditions of cancellation and the consequences of the Customer's no-show at BellevigneBourgogne are specified in the Conditions of Sale of the reserved fare.
Stay in BellevigneBurgundy
All guests must present valid identification at check-in.
Foreign customers, including accompanying adults and teenagers over the age of 15, are required to complete an "individual police form". Children under the age of 15 may appear on the card of an accompanying adult. The information contained in these forms is governed by article R.611-42 of the French Code de l'entrée et du séjour des étrangers et du droit d'asile.
The customer may not bring third parties into the room without the express permission of Bellevigne Bourgogne, which reserves the right to carry out any necessary checks.
Only guide or assistance dogs are allowed on Bellevigne Bourgogne.
The Customer accepts and undertakes to use the room and the common areas made available to him/her in a reasonable manner. Any behavior contrary to the principles of safety and/or hygiene, morality and/or public order may lead Bellevigne Bourgogne to ask the Customer to leave the establishment, without refund.
Any damage caused by the customer or by the customer's occupants in the room or in the various areas occupied by the customer during the stay may be billed directly to the customer for the cost of repairing the damage. Any damage caused must in any case be reported to Bellevigne-Bourgogne reception.
Room equipment (excluding consumables) provided to the customer, such as towels, bathrobes, carafes, coffee machines, kettles, etc., are the property of Bellevigne Bourgogne. Should Bellevigne Bourgogne discover that they are missing after the customer has handed over the room, Bellevigne Bourgogne may invoice the customer for these items.
For safety reasons and out of respect for everyone, smoking is strictly forbidden on the premises of Bellevigne Bourgogne. In accordance with the French Public Health Code, which sets out the conditions for the application of the ban on smoking in public places, smoking on the premises of Bellevigne Bourgogne exposes the customer to a third-class fine.
Penalties of up to the price of the room booked may be applied if theCustomer does not respect the no-smoking sign in the room.
If the customer does not check out at the time indicated in the Conditions of Sale for the rate booked, an additional night will be charged.
On arrival, the hotel may request a security deposit or pre-authorization to debit the Customer's credit card (no debit will be made) in the amount of 150 euros, which will be used in the event of any damage, without prejudice to any other rights and remedies. This pre-authorization will be cancelled on the Customer's departure in the absence of damage.
Liability
The photographs presented on the Site are not contractual. Although every effort is made to ensure that the photographs, graphic representations and texts reproduced to illustrate Bellevigne Bourgogne give as accurate an idea as possible of the accommodation services offered, variations may occur, notably due to changes in furnishings or possible renovations. The customer is not entitled to any claim in this respect.
In accordance with the laws and regulations governing intellectual property rights, the use and/or reproduction of all or part of the elements making up the Site's offerings is strictly prohibited.
Any reservation or payment that is irregular, inoperative, incomplete or fraudulent for any reason attributable to the Customer will result in the cancellation of the reservation at the Customer's expense, without prejudice to any civil or penal action against the Customer.
Bellevigne Bourgogne reserves the right to refuse to receive or to expel, without refund, any Customer whose dress is inappropriate, indecent and/or negligent, any Customer whose behavior is noisy, improper or alcoholic, or any Customer whose behavior is contrary to hygiene, good morals or public order. Correct dress is required in the restaurants and public areas of BellevigneBourgogne. Customers must be courteous and respectful towards Bellevigne Bourgogne staff. On pain of exclusion without reimbursement, theCustomer must refrain from any verbal or physical violence, racist behavior or remarks, or any form of harassment.
Price
Prices for accommodation and services are communicated before and at the time of booking.
The prices quoted are per room for the number of persons and date(s) selected. Upon confirmation of the customer's reservation, the total amount of the reservation will be indicated. Prices include VAT applicable on the date of booking, and any change in the VAT rate will be automatically reflected in the prices quoted on the date of invoicing.
Prices are confirmed to the customer inclusive of all taxes, in the commercial currency of Bellevigne Bourgogne (the Euro). Prices are valid for a limited period only.
Tourist tax and any other taxes specific to the communes indicated for each rate are not included in the advertised rate and must be paid directly to the hotel at check-in or check-out.
For Bellevigne-Bourgogne, the tourist tax is €2.55 per adult per night.
Any change or introduction of new legal or regulatory taxes imposed by the competent authorities will automatically be reflected in the prices indicated at the time of invoicing. Rates may be increased by different taxes depending on the city/country. These taxes will be communicated to the customer at the time of booking, if they are known to Bellevigne Bourgogne at that time. Otherwise, they will be displayed at the Bellevigne Bourgogne reception desk. The customer undertakes to pay all taxes to Bellevigne Bourgogne without any dispute.
Bellevigne Bourgogneguarantees that the best rates are offered on the Site. If, after having booked on the Site, the Customer finds within 24 hours an equivalent offer for the same date(s), at a lower rate, the same number of people and the same type of room, the same services with the same conditions of sale (cancellable or not, refundable or not) on another Internet site, tourist tax and booking fees included, Bellevigne Bourgogneguarantees you this rate with an additional 10% discount.
Payment
The customer communicates his payment details either (i) to prepay the reservation in full or in part before the stay, or (ii) as a guarantee for the reservation in the event of a "no show".
In the case of a credit card, the information required is: the credit card number, the validity date (it is specified that the credit card used must be valid at the time of the stay) and the visual cryptogram in the case of prepayment.
All booking steps are secured using SecureSocket Layer (SSL) technology. Customer information is encrypted and protected by server authentication and data stream encryption. The security certificate used is issued by Sectigo, an accredited third-party company, and is used by the D-Edge reservation system. In addition, the booking system is hosted in a secure server environment equipped with biometric security, firewalls and other advanced technologies to prevent interference and intrusion.
The customer's payment card is subject to security checks (credit check, card country check, IP address country check) by the designated partner and may be refused for a number of reasons: stolen or blocked card, ceiling reached, input error, etc. In the event of a problem, customers should contact their bank and Bellevigne Bourgogne to confirm their booking and payment method. On-line payment methods available and communicated include Visa, Mastercard and American Express. This list is subject to change.
In the event of payment to Bellevigne Bourgogne, the latter may accept other means of payment (cash), but the customer must present Bellevigne Bourgogne with the bank card used to guarantee the reservation or make the prepayment, in order to verify the customer's identity. Bellevigne Bourgogne may also ask the customer to show proof of identity in order to prevent credit card fraud.
Cheques are not accepted at Bellevigne Bourgogne.
At the time of prepayment, the amount debited at the time of booking includes: the price of the stay (including accommodation, taxes related to accommodation, the price of catering, taxes related to catering) and any additional services selected by the customer, excluding tourist tax and/or any other tax due as a result of the customer's stay at Bellevigne Bourgogne.
Personal data
It is hereby agreed that Bellevigne Bourgogne is the data controller in the sense of the applicable regulations, i.e. Regulation (EU)2016/679 of April 27, 2016 known as the General Data Protection Regulation(GDPR) and Law n°78-17Informatiques et libertés in its updated version.
In this respect and as part of the contract between us, Bellevigne Bourgogne undertakes to process the personal data entrusted to us by the Customer in compliance with the provisions of the RGPD and in accordance with its data protection policy available here.
In accordance with article L223-2 of the French consumer code, consumers who do not wish to be the subject of commercial prospecting by telephone can register for free on a list of opposition to telephone canvassing, in particular via the website www.bloctel.gouv.fr.
The customer acknowledges that he/she has been fully informed that, at the end of his/her stay at Bellevigne Bourgogne, the e-mail address used to make the reservation will be used for prospecting purposes concerning similar products or services offered by Bellevigne Bourgogne, by the sending of a newsletter. You can unsubscribe at any time by clicking on the unsubscribe link in each newsletter.
Proof agreement
Entering the required banking information, as well as accepting the General Terms and Conditions and the Conditions of Sale for the rate booked, constitutes acceptance of the hotel contract between the parties, with the same value as a handwritten signature.
Computerized registers stored in MEWSSYSTEMS' computer systems will be kept in reasonable conditions of security and will be considered as proof of communications, orders and payments between the parties.
Force majeure
Neither party shall be liable to the other in the event of non-performance of its obligations as a result of force majeure.
It is hereby expressly agreed that force majeure shall suspend the performance of the parties' mutual obligations and that each party shall bear the costs arising therefrom.
Cases of force majeure are those usually recognized by the case law of the Cour de cassation.
In the event of force majeure or any other exceptional event that prevents Bellevigne Bourgogne from providing the room reserved for the customer, Bellevigne Bourgogne may offer accommodation in a hotel of at least the same category or, if it is of a lower category, a room of a higher standard than the one originally reserved, for services of the same nature. Any additional costs associated with this relocation, for services of the same nature, will be borne by Bellevigne Bourgogne.
In the event that the customer does not agree to relocation, or if relocation is impossible, the customer may agree with Bellevigne Burgundy to postpone the stay or, failing agreement between the parties, cancel the reservation, in which case an immediate refund will be made.
Anticipation
The General Terms and Conditions of Sale expressly exclude the legal regime of unforeseeability provided for in article 1195 of the French Civil Code. Bellevigne Bourgogne and the Customer hereby waive their right to avail themselves of the provisions of article 1195 of the French Civil Code and of the unforeseeable circumstances provided for therein, and undertake to assume their obligations even if the contractual balance is upset by circumstances which were unforeseeable when the contract was concluded, even if their performance proves excessively onerous, and to bear all the economic and financial consequences thereof.

Applicable law
The GCS are governed by French law.
Bellevigne Bourgogne informs the customer of the possibility of resorting to a conventional mediation procedure or any other alternative dispute resolution method, in the event of a dispute relating to these GTS, in accordance with the conditions set out in Title I of Book VI of the French Consumer Code.
After contacting Bellevigne Bourgogne's customer service department (contact@bellevigne.com)to try to resolve the dispute amicably, and in the event of a negative response or the absence of a response within sixty (60) days from the date of referral, the customer may refer the matter to the Médiateur Du Tourisme et du Voyage by e-mail using the referral form available on the www.mtv.travel website, or by post to the following address:

Bellevigne Bourgogne also informs the Customer of the existence of a European platform for the Online Settlement of Disputes to which he may have recourse. Customers can access it here.
Complete
The General Terms and Conditions, the Terms and Conditions of Sale of the fare booked by the Customer, and the booking confirmation express the entirety of the obligations of the parties.
No general or specific conditions communicated by the Customer may be incorporated into the GTCS.
In the event of any discrepancy between the Booking Confirmation containing the Conditions of Sale for the fare booked and the GTCS, the provisions of the Booking Confirmation shall prevail.
